The 21-year-old actress is being sued for negligence over the accident in which her Mercedes-Benz hit a van and injured the driver, Raymundo Ortega. Ortega, a busboy, alleges Lohan had been drinking at The Ivy restaurant before the crash even though she was underage at the time. Ortega is seeking at least $200,000 in damages from Lohan and the restaurant. But in a Dec. 15 declaration, Lohan stated: "I did not consume an alcoholic beverage or any type of medication or drug" either before or during her restaurant visit. A call to Lohan lawyer David Ozeran wasn't immediately returned Wednesday. Lohan's declaration was filed Friday in Superior Court by lawyers for The Ivy along with other documents, including a declaration by the waiter who served Lohan. The server, Adam Novicki, said Lohan didn't order alcohol. Alonzo Howell, a Los Angeles police officer who was providing security for The Ivy that day, also said he didn't see Lohan drinking. Lohan has countersued Ortega, citing a California Highway Patrol report that said he was at fault for the crash because he made an illegal U-turn. Lohan served 84 minutes in jail last month after pleading guilty to misdemeanour drunken driving and cocaine charges unrelated to the 2005 crash.

Lindsay Lohan called into a Las Vegas radio station on Friday in an effort to score Hannah Montana tickets for a friend's nieces – and ended up chatting with the hosts about how her life is going. "I think my life is different now, and it's changed, and I'm growing up," Lohan, 21, told the morning hosts at Mix 94.1 FM– which just happens to be giving away tickets to people who get celebs to call in. "It was time to grow up. I've gone through a lot, and I'm just a different person now," said Lohan, later saying, "It's amazing, everything's going so well." She also discussed her current projects – mostly musical in nature. "I've been in the studio, and it's going really well, and I'm really excited, 'cause it's going to be more urban pop," she said. "It's good to be back in the studio." She declined to discuss her love life ("I don't kiss and tell"), but added that she hopes she can plan a trip to Africa on a humanitarian mission sometime soon. Lindsay Lohan is now spending time with her ex, Stavros Niarchos, after she dumped rehab buddy Riley Giles a week ago. Lindsay Lohan's next performance may be direct-to-video - despite her lawyer's efforts to stop the production. On Wednesday, and LA Superior Court judge denied Lohan's bid to bar a video camera from her upcoming deposition in a civil lawsuit involving a car crash to years ago. The ruling came after the strong objections of Lohan's attorney, who says he fears the video would be sold by one of many people who'd have access to it. "If a single picture of Ms. Lohan can sell for thousands of dollars, a videotape of the deposition will undoubtedly sell for tens of thousands of dollars, or more," her attorney wrote in court papers. He added that he believes the real purpose of videotaping is to "annoy Ms. Lohan and to attempt to gain a litigation advantage by causing her concern about the embarrassment of such a videotape." Lohan is to be deposed in a lawsuit brought by Raymundo Ortega, an LA busboy alleging the actress had been drinking when she crashed a black Mercedes-Benz convertible into his van in West Hollywood in 2005. Lindsay Lohan reported to the Lynwood jail on Thursday to serve her minimum 24-hour sentence as part of her plea deal in her two DUI cases - and checked out 84 minutes later. According to the sheriff's department website, the actress turned herself in at 10:30 a.m. and was released at 11:54 a.m. The jail has a long-standing policy of releasing non-violent offenders early due to overcrowding. "Ms. Lohan was cooperative," said a sheriff's spokesperson. "She was fingerprinted, photographed, and put in a holding cell, but was let go due to our early release policy." On Monday, Lohan began her court-ordered community service at an American Red Cross blood services facility in an LA suburb. Although the actress was sentenced in August to four days in jail for her second DUI conviction, prosecutors agreed she could serve 10 days of community service in lieu of two days behind bars. Lohan was also given credit for one day served from her July arrest. The 21-year-old is on probation for three years and must complete an 18-month alcohol program. Lindsay Lohan has filed a countersuit against a busboy who sued her alleging she was trying to flee photographers when her car hit his van in West Hollywood two years ago, court papers show. Lohan lodged the countersuit in response to the negligence suit filed June 14 by Raymundo Ortega of Los Angeles. Ortega also alleges the starlet had been drinking and is seeking at least $200,000 in damages. The collision between Lohan's $200,000 Mercedes-Benz SL65 and Ortega's van occurred at about 5 p.m. on October 4, 2005 near Robertson and Beverly Boulevards. Ortega alleges the actress was looking over her shoulder instead of watching the road because she had been sensitive to a paparazzi and often drove recklessly after a May 2005 accident in which a photographer rammed her car. However, in her four-page countersuit, Lohan maintains that Ortega and an unspecified number of defendants she will name alter were all "negligent in the ownership, operation, repairs and maintenance" of his van. Lohan is asking for more than $75,000 in damage for the repair of her car and the cost of renting other vehicles. Everything in my life came to a point where I had to make a decision; the arrest that night helped me come to a point where I had to make one."
On how she plans to stay on the road to recovery: "[By surrounding myself] with good people who have their hearts and their minds in the right places."
On her small role in her new film about Tango legend Carlos Gardel: "I'm staying in Utah until it's time to shoot Dare to Love Me and then I plan on returning to Utah so I can stay focused and avoid other distractions."
On not saying goodbye to Hollywood: "Absolutely not - never! I'm here to stay. My talent is a gift, and I'm going to use it in the right way."
On her parents' feud: "I wish it would stop. It hurts when two people you love argue with one another. I don't think any child wants to see their parents argue or see their family fall apart. Unfortunately, it happens, and when it does, they should do it with as little effect on their children as possible."
On rehab: "[It was] sobering [and] humbling. It made me look at myself, and all of the people, places and things in my life in a different way. I was in there for substance abuse, after all."
On the potential of relapse: "If I wasn't [worried], I'd be living in denial. Temptation is always there, but now I'll avoid it the right way."

Despite denials earlier in the week, Lindsay Lohan has checked out of the exclusive Cirque Lodge Treatment Center in Utah, where she has been since August. Multiple sources, including her parents, have confirmed the news. "She's finished the program," one source says. "Lindsay is done, but she may come back for outpatient treatment. She overextended her stay because she wanted to. She could have been out a while ago, but she chose to stay." Lohan's mother said yesterday, "I'm proud of her. She's moving ahead with her life. Things were getting out of control. She took action. She took responsibility. She really needed to heal." Lohan was photographed on Friday afternoon with her father Michael, who carried her suitcases, leaving Cirque Lodge. "I will be there in her life as best I can but from here on she's going to have a lot of decisions to make on her own," Michael said yesterday. "Now that she is going out into the world, I can only hope for the best." Lohan is already gearing up for her return to work - a source says she has plans to start filming her tango-themed flick Dare to Love Me in LA beginning October 15. Despite reports suggesting she is an insurance liability for film studios, Lohan has been insured for this film. "Lindsay will start her life over," says a source. Sources say Lohan is in family therapy all week with her father, as previously reported. She will be heading to LA soon for some minor dental work, but once her choppers are fixed, Lohan will return to Cirque.

Lindsay Lohan's father is heading to Utah next week to spend five days of "quality time" with his troubled daughter - a visit he hopes will help in her battle to stay clean and sober. "We've still got a lot of catching up to do," said Michael Lohan, who reunited with the Mean Girls starlet for two days at the Cirque Lodge earlier this month after a two-year estrangement. This time, Michael will take his daughter from the facility to a remote, undisclosed location in Utah as part of out-patient therapy. "I'm looking forward to spending the next week with her," he said. "We've been in constant phone contact. She's in a great, great place now. I've never heard her so honest, contrite and focused. Lindsay is weeding out all the bad. She's taking a step back and reevaluating her life. What she tells - her honesty and openness - has brought me to tears. It's beyond words how proud I am of her," Lohan Sr. said. Sources says Michael and Lindsay wanted next week's visit and counselors gave their blessing. Dina Lohan's new boyfriend has fired back at Michael Lohan for calling him a boozer unfit to be around his kids. Jim McMillan, in an email sent to Page Six, calls the troubled father of Lindsay Lohan a violent, drug-abusing criminal who never deserved his "classy, intelligent" ex-wife. Last month, Michael had his lawyer write to Dina, complaining she had shacked up in the family's Long Island home with McMillan. He charged McMillan gets drunk around his youngest kids - Michael, 19, Ali 13, and Dakota, 10 - and makes inappropriate comments. "He is no example. Nor is he a substitute father," Michael said. In a scathing response, McMillan rages: "First and foremost, I am a gentleman. I have never been inebriated in front of [the children] or said anything about a man I know nothing about. I did decide to learn about Michael Lohan and did a quick background check. The following is public record, fact and irrefutable: on 10/13/84, you struck, choked and kicked Susan L. Hubbard of Ohio, causing fractured facial bones. In [New York], there are 10 arrest records found for securities fraud, DWI, assault, grand larceny... Dina has never been arrested or charged with anything." McMillan then addresses Lohan directly: "Upon getting out of jail, you hire a publicist and start a smear campaign against your children's mom. You take a photo of her holding a water bottle at your daughter's premiere, and you call her a party mom. You...accuse her of being an alcoholic, a drug user, an unfit mom and a philanderer. You do it in a very public way and force them to deal with the fallout. If you want to assassinate someone's character, leave Dina alone. She is way out of your league. She is a classy, intelligent, loving mom..." McMillan closes the letter by urging, "Work hard, support your children, stay clean and sober, privately make amends for the physical and psychological abuse you have inflicted in the past, so your children can have closure." The Lohans recently finalized their divorce and custody issues, and Dina lobbied Lindsay to allow her father to visit her in rehab.
